Unfair Redundancy?

An employer must follow a fair process whenever they want to make someone redundant.

Redundancy should only be a last resort. It should only happen after all redeployment options have been exhausted.

Before someone is being made redundant, there should be a genuine consultation. This consultation should give employees all of the relevant information they need to comment on the proceedings, and should give them an opportunity to provide alternatives.

Further, the notice give for a redundancy must be reasonable. If notice is not specified in the contract, what is reasonable depends on the reason for the redundancy, the employee’s length of service, the custom, practice and industry norms and the amount of compensation being paid.
