Bereavement Leave

Bereavement leave is a form of paid leave that you can take when a family member or someone close to you has died.

Is everyone entitled to bereavement leave?

As an employee, to be eligible for bereavement leave you must:

  • have been working continuously for a minimum of six months as part-time or full-time; or
  • been working for six months for an average of 10 hours per week and at least one hour in every week, or 40 hours in every month.

How much leave am I entitled to?

An employee gets bereavement leave for a minimum of three days per death, if a spouse or partner, parent, child, sibling, grandparent, grandchild or spouse or partner’s parents dies.

What if the person who died is not in the listed criteria?

If a person close to you dies and they do not meet the criteria listed above then you are entitled to a minimum of one day per death, if your employer accepts that you have had a bereavement.

An employer will base this decision on how close you were to the deceased person, how much responsibility you have for arrangements for the ceremonies relating to the death and if you have any cultural responsibilities in relation to the death.
